Homeowners’ Insurance provider leaving the state (Crosbyton, July 21, 2008) - Representative Joe Heflin, House District 85 (HD85), reported that he has been informed by the Texas Department of Insurance that Austin Indemnity Lloyds Insurance Company (Austin Indemnity)is withdrawing from the Texas Market and has sent out non-renewal notices to holders of its homeowners policies in Texas. The Texas Department of Insurance informed Rep. Heflin that Austin Indemnity has policyholders in HD 85. HD85 includes these sixteen counties: Borden, Crosby, Fisher, Floyd, Garza, Glasscock, Hale, Howard, Irion, Jones, Kent, Lynn, Reagan, Sterling, Stonewall, and Terry. The Texas Department of Insurance has been working with Austin Indemnity and is aware that the company intends to stop writing homeowners' insurance policies in Texas. Heflin stated that "policyholders should work with their insurance agents to address their specific situations so their questions can be answered and to develop options to ensure their homes and property are protected." Rep. Heflin Comments on PUC Vote on Transmission Lines (Crosbyton, July 18, 2008) - Representative Joe Heflin (D-Crosbyton), House District 85, is pleased to report that the Texas Public Utility Commission (PUC) on Thursday approved "scenario 2," which is the transmission line plan that will eventually move a total of 18,456 megawatts of wind power from West Texas to the state's power grid. According to the PUC news release, scenario 2 is estimated to cost $4.93 billion or $4 per month per residential customer and will be completed within four to five years. Rep. Heflin stated: Several counties in House District 85 have been designated by the PUC as proposed routes for the new transmission lines to move the energy produced by our West Texas wind farms to the rest of the state. Scenario 2 appears to be a good plan that benefits the existing wind farms, as well as giving companies the assurances they need to invest in and develop even more wind farms. Heflin went on to say that: The lack of transmission lines created a situation where the power currently produced by the wind farms was constrained by the lack of available transmission lines. The increased transmission capacity will spur the development of even more wind farm projects, which is good for the residents and economy of our area. Developers now know that expanding their wind farm operations is good business because when the new transmission lines are built, additional energy can be produced and loaded onto the grid. This is a win-win for our area and the state. The House District 85 counties currently included in the proposed routes for the new transmission lines are: Borden, Fisher, Floyd, Glascock, Howard, Jones, Kent and Sterling. The PUC will take a final vote on its transmission line plan either later in July or sometime in August. Craddick Appoints Heflin to the Select Committee on (Austin) - Speaker Tom Craddick (R-Midland), today, appointed Rep. Joe Heflin (D-Crosbyton) to the Select Committee on Property Tax Relief and Appraisal Reform. The committee will oversee all matters related to tax relief and reforming the property appraisal system. "Rep. Heflin's appointment ensures that West Texas taxpayers have strong representation on this committee," Speaker Craddick said. "He is a well-respected lawmaker who will work hard with the other committee members as they come up with a solution to this issue." The committee will review the sections of the Texas Constitution and the tax code that limit or authorize limiting the appraised value or increases in the appraised value of property for tax purposes. JOE HEFLIN HONORED BY WEST TEXAS COUNTY FORT WORTH (March 31, 2008) – On March 26, State Representative Joe Heflin (HD85) was presented the Sam D. Seale Award of Excellence by the West Texas County Judges and Commissioners Association at its 79th Annual Conference. Roberts County Judge, Vernon Cook, president of the association, conferred the award during the General Session on Wednesday morning and noted that Heflin's achievements during his freshman term in the Texas House of Representatives were very impressive. Rep. Heflin, a former Crosby County Judge and past member of the association, told the group assembled that much of his success in the Legislature was due to their continued help during the session. He urged all those present to stay in contact with their representatives and to be involved in the legislative process. Further, Heflin thanked the association for bestowing upon him such a meaningful recognition stating that he was humbled and pleased by the honor because of his tremendous respect and admiration for the late Sam Seale. Association officials commented that Heflin is only the second person to receive the award, which recognizes outstanding service to the West Texas Association as exemplified by the late executive director of the Texas Association of Counties, Sam D. Seale. Other awards Rep. HOUSE COMMITTEE ON AG & LIVESTOCK TO MEET IN TERRELL, TEXAS Crosbyton (February 6, 2008) – Examining the opportunities for increased economic development funding for rural Texas will be the focus of the first interim meeting of the House Committee on Agriculture & Livestock. State Representative Joe Heflin, a member of the committee, will attend the meeting at 1 p.m., Monday, February 11, in the Board Room of the Terrell Independent School District. Presentations are expected to be directed toward increasing potential for growth and for prosperity in rural Texas. Heflin is looking forward to hearing the ideas of those experts scheduled to testify. Commenting that the state too often concentrates its strategies for economic development on large municipalities, Heflin said, "It is time to focus on the needs of rural areas. HEFLIN TO ATTEND JOINT MEETING OF HOUSE COMMITTEES TO BE HELD IN DALLAS Crosbyton (January 21, 2008) – Illegal immigration and border security issues will be on the agenda when State Representative Joe Heflin attends a joint House Committee meeting in Dallas. Heflin, a member of the House Committee on County Affairs, will attend the joint meeting with the House Committee on Corrections at 10:30 a.m., Friday, February 1, in the University Theatre at the University of Texas at Dallas. Representatives will hear testimony on illegal immigration and border security policies and procedures of the Texas Department of Criminal Justice (TDCJ), county probation departments, and local and county jail facilities. The joint committee is expected to make recommendations to improve the coordination of international, federal, state, and local authorities on illegal immigration and border security matters. REP. JOE HEFLIN: “RETIRED TEACHERS ARE ONE STEP CLOSER AUSTIN (October 21, 2007) – Representative Joe Heflin announced this week that retired school employees, including retired teachers, are one step closer to receiving the so-called ‘13th month’ paycheck authorized this spring by the 80th Texas Legislature. Heflin said he has been informed that the pension fund for the Teacher Retirement System of Texas (TRS) should have sufficient funds to issue the checks in January 2009. Rep. Heflin expressed pleasure at being a part of the Legislature that adopted the benefit increase. “This is an important first step in helping our retired school employees who have not had a benefit increase in six years,” noted Heflin. “I am committed to working to ensure that our retired public school employees do not have to wait so long to receive another benefit increase,” he continued. Last spring the Legislature passed Senate Bill 1846 authorizing TRS to issue a ‘13th month’ check to certain retirees. The Legislature also increased the state's contribution to the TRS pension fund to help pay for the benefit increase. The ‘13th month’ check is a capped amount up to $2400 per retiree and is for those who retired on or before December 31, 2006 . Final action will not be taken or details worked out until a TRS Board vote at its November 9, 2007, meeting. Nonetheless, according to the House sponsor of Senate Bill 1846, the independent actuary for the fund has informed TRS that sufficient funds should be available. “This should come as welcome news to our retired school employees,” Heflin concluded. The new law requires that state contributions to TRS be at least equal to or greater than member contributions. This additional funding helped the pension fund's actuarial position so it could afford the ‘13th month’ check. JOE HEFLIN NAMED LEGISLATOR OF THE YEAR GALVESTON (September 27, 2007) – Joe Heflin, State Representative HD 85 from Crosbyton, was honored as the 2007 Legislator of the Year by the County Judges and Commissioners Association of Texas at the Association’s 85th Annual Conference this week. Heflin was introduced to the conference by Association President Mark Evans, Trinity County Judge, and James P. Allison, General Counsel for the Association. Presenting Heflin to the conference, Allison stated, “Heflin came to Austin ready to go to work. It may have been his freshman term, but he certainly did not act like a freshman. He carried many bills important to counties, including a bill to prevent a major unfunded mandate for the May Constitutional Amendment Election regarding property taxes.” The unusual May election was a holdover from special terms of the previous, 79th Legislative Session. Counties normally hold general elections in November and primary elections in March. Concluded Allison, “Heflin fought like a bulldog to make sure that the counties were reimbursed for the extra expense.” Heflin admitted that he was excited and gratified to win the award. “My experiences as County Judge and as a City Council Member give me a close connection to these local governments. The award from the County Judges and Commissioners Association is the latest in a string of awards for Heflin’s work during his freshman term in the legislature. The Texas Association of Counties recognized him as a “Friend of County Government” and the Texas Municipal League named him Legislator of the Month in March. REPRESENTATIVE JOE HEFLIN: $45 THOUSAND STATE GRANT AWARDED FOR BROWNFIELD KIDDIE PARK (AUSTIN) September 5, 2007 – State Representative Joe Heflin today announced that the Texas Parks & Wildlife Commission has awarded the City of Brownfield a $44,548 grant for the Kiddie Park in the south central part of the city. The Small Community Grant will allow Brownfield to renovate the Kiddie Park, setting up new playground equipment and helping to assure park safety. “Money for the matching grant comes from funds appropriated by the Legislature to the Texas Parks & Wildlife Department for recreational lands and facilities,” said Rep. Heflin. “I am very pleased that the children and citizens of Brownfield will benefit from the available state funds for projects of this type,” he added. According to Rep. Heflin, the funds for these matching grants come from a portion of the state sales tax on sporting goods. The city will contribute matching funds to support the park projects, including possible re-surfacing, fencing, and signage. Rep. REP. HEFLIN ANNOUNCES BIG SPRING AIRPORT IMPROVEMENT GRANT AUSTIN (August 23, 2007) – State Representative Joe Heflin this week announced that the City of Big Spring has been offered a $60,000 grant from the Federal Aviation Administration to fund improvements at the Big Spring McMahon-Wrinkle Airport . The grant is expected to pay about 90 percent of the airport layout project costs to improve the city's aviation facilities. According to Rep. Heflin, word of the FAA grant came through the Texas Department of Transportation (TxDOT) earlier this week. “I am delighted that Big Spring received this grant,” said Rep. Heflin. “The airport layout project will enhance the safety, capacity, and security of McMahon-Wrinkle Airport , and the FAA grant will allow the improvements to be made at a cost to the city of only 10% of the total estimated project costs.” Rep. Heflin expressed his appreciation to TxDOT and FAA officials, thanking them for recognizing the important role that regional airports like McMahon-Wrinkle play in enhancing economic opportunities in the region. “It is vitally important that all levels of government work together to attract new businesses to West Texas and to improve the economic climate of the area,” Heflin added. OF ANNUAL SALES TAX HOLIDAY AUGUST 17-19 AUSTIN (August 14, 2007) -- State Representative Joe Heflin reminded Texas families that the annual back-to-school Sales Tax Holiday starts at 12:01 a.m. on Friday, August 17, and ends at midnight on Sunday, August 19. "The annual Sales Tax Holiday is a great way for Texas families to save money as they prepare for the upcoming school year," said Rep. Heflin. He noted that during the three-day weekend, consumers will be able to buy, tax free, most clothes and shoes priced under $100. Because of a recent change in the law, shoppers also can purchase school backpacks for elementary and secondary students tax-free this year. Rep. Heflin explained that consumers will not be required to pay state or local sales tax on items less than $100, no matter how much they buy. In addition to the relief from the state sales tax of 6.25%, communities across Texas also have chosen to waive their local sales taxes, saving taxpayers an additional 2% in some areas. Since the first Sales Tax Holiday in August of 1999, Texans have saved over $300 million in sales taxes. "Texans will not be charged sales tax on tax-exempt items placed on layaway or items bought out from layaway during the Sales Tax Holiday," Rep. Heflin said. STATE REP. HEFLIN: “WORK OF 80TH REGULAR SESSION COMPLETE” AUSTIN (June 2, 2007) — State Representative Joe Heflin (D-Crosbyton) returned to District 85 last week following the final gavel on the 80th Regular Session of the Texas Legislature. Despite a sometimes tumultuous session, Rep. Heflin said the citizens of District 85 will be pleased with what was accomplished. During the 80th Regular Session, Rep. Heflin voted to raise the homestead exemption, for an across-the-board teacher pay raise, to lower skyrocketing college tuition costs, against gutting public schools with private school voucher schemes, and to fully restore funding of the children's health insurance program (CHIP). Heflin highlighted the votes for teacher pay raises and increased CHIP funding, recounting that those were two of the biggest issues in his election campaign. “This session we passed an across-the-board teacher pay raise and restored health insurance coverage for over 127,000 Texas children,” Heflin said. “We could have accomplished more with such a large budget surplus, but at least we turned the herd in the right direction.” At the start of the 80th Regular Session, the Legislature was told the state would have the largest surplus in history -- $14.3 billion. The Legislature spent $11 billion of that $14.3 billion surplus on property tax cuts. “I am glad we got a tax cut passed,” said Heflin. “It is the taxpayers’ money after all.” Heflin continued, “Now we need to turn our attention to other priorities. Texas needs quality schools, first-rate health coverage, and affordable college tuition. We need to do more to invest in the future of Texas.” Here are some of the major issues Rep. Heflin worked on for District 85 citizens this session: Public Education Supported raising teacher salaries to the national average, but was forced to settle on an across-the-board teacher pay raise of $425 a year. Higher Education Maintained the Top 10% law, protecting the right of West Texas students to attend Texas' top tier universities. (SB 101). Health & Human Services Voted to restore cuts made in 2003 for the Children's Health Insurance Program (CHIP). As many as 127,000 more children will receive CHIP coverage thanks to actions taken during the session, but there still will be 100,000 fewer children enrolled in CHIP than there were in 2003. HEFLIN NAMED FRESHMAN LEGISLATOR OF THE YEAR AUSTIN (May 18, 2007)—Today District 85 State Representative Joe Heflin (D-Crosbyton) was named Freshman Legislator of the Year by his Democratic colleagues in the 80th Texas Legislature. Heflin previously was recognized by Capitol Inside as the second most powerful freshman legislator this session, and in March, the Texas Municipal League honored him as its Legislator of the Month. Heflin serves on the House Agriculture & Livestock and County Affairs Committees. He also was appointed by House Speaker Tom Craddick (R-Midland) to serve on the Agriculture, Environment and Energy Committee of the National Conference of State Legislatures. HEFLIN ENCOURAGES VOTE IN SPECIAL ELECTION Constitutional Amendment for Tax Relief for Seniors and Disabled on Ballot AUSTIN (May 3, 2007)—State Representative Joe Heflin (D-Crosbyton) reminded voters of the special election set for Saturday, May 12, to vote on a constitutional amendment granting tax relief to senior citizens and the disabled who have a homestead exemption on their homes. The 80th Texas Legislature authorized the special constitutional amendment election to correct an oversight in legislation lowering school property taxes that passed during a special legislative session last spring. In addition to the constitutional amendment election, voters in many areas will have a chance to cast ballots for local school boards and in city council races. HEFLIN AMENDMENT KILLS STATE SPENDING
ON PRIVATE SCHOOL VOUCHERS AUSTIN (March 31, 2007)—Making good on a campaign promise, State Representative Joe Heflin scored a stunning victory for West Texas public schools late Wednesday night, convincing an overwhelming majority of the Texas House to prohibit any state spending on private school vouchers. By a vote of 129-8, the House approved Heflin’s amendment to the state budget bill, an amendment that bans taking tax dollars from public schools and diverting them to private schools. A statewide voucher plan would cost the public schools billions of dollars and particularly hurt cash-strapped schools in West Texas. Two years ago, the House came within one vote of approving private school vouchers. Private school vouchers became the central issue in Heflin’s campaign last November. In that election, Heflin overcame an opponent who supported vouchers and who was backed by thousands of dollars from a voucher-supporting San Antonio multi-millionaire. “I’m in Austin to be a messenger for West Texas,” Heflin said. “Public schools are the lifeblood of our communities, and they provide our children with the best opportunity to succeed. Now, West Texans have sent a loud and clear message: ‘No, to private school vouchers.’” Heflin’s victory is particularly remarkable because first-term legislators ordinarily pass few bills and rarely make significant contributions to major bills. House Bill 1, which is the proposed budget for the 2008-09 biennium, was approved with the Heflin amendment and now will be sent to the Texas Senate before being forwarded to the Governor. Heflin expressed his appreciation for the support of other House members. “This was my first opportunity to take a clean shot against funding private school vouchers,” he said. “I am very grateful to my colleagues that it succeeded.” Heflin cautioned that the battle over private school vouchers is not over. He pointed out that the Senate could eliminate his anti-voucher amendment from the state budget and that the Senate will soon consider another bill to fund vouchers. “But this is a heck of a start,” Heflin concluded. HEFLIN APPOINTED TO NATIONAL LEGISLATIVE CONFERENCE COMMITTEE FOR AGRICULTURE, ENERGY AND THE ENVIRONMENT AUSTIN (March 14, 2007)—State Representative Joe Heflin was appointed to a two-year term on the Agriculture, Environment and Energy Committee of the National Conference of State Legislatures (NCSL) by Texas House Speaker Tom Craddick (R-Midland) earlier this week. The Agriculture, Environment and Energy Committee reviews state and federal agriculture and rural development legislation as well as natural resources, energy, and electric utilities legislation. Among other things, the Agriculture, Environment and Energy Committee seeks to ensure that Congress and federal agencies are sensitive to how proposed laws and regulations impact rural areas and their surrounding communities. Recent issues before the Committee have included the farm bill, water allocation, rural health care, education and telecommunications, as well as energy efficiency and renewable energy. HEFLIN MOVES TO ELIMINATE CONFUSION OVER POSSIBLE CRIMINAL LIABILITY OF COUNTY CLERKS AUSTIN (March 8, 2007)—State Representative Joe Heflin (D-Crosbyton), joined other members of the Texas House of Representative last week to pass a bill overriding a recent opinion of Texas Attorney General Greg Abbott making county clerks criminally liable for failing to redact social security numbers from documents considered to be public information, including information available over the internet. Previously, county clerks were required by law to include the information on certain documents filed of record in the county clerks’ offices. Responding to the state legislature’s prompt action in the passage of House Bill 2061, the attorney general issued a 60-day abatement of his previous opinion to allow the legislature adequate time to address the underlying issues. Representative Heflin voiced his approval of the legislature’s quick passage of HB 2061. “I am very glad the legislature moved quickly to correct this situation that was causing confusion and frustration for our county clerks as well as for those in the land title business and those whose very livelihoods depend on their ability to use the information in our public records. Many county clerks called my office concerned that they might become criminals just by doing the jobs they were elected to do, in the manner they were instructed to do so,” Heflin said. HEFLIN RECEIVES PRIME COMMITTEE APPOINTMENTS AUSTIN (January 28, 2007)—State Representative Joe Heflin was appointed to the Agriculture & Livestock and County Affairs Committees when committee assignments were announced Friday afternoon. A former county judge in Crosby County, Rep. Heflin received a seniority appointment to the County Affairs Committee, and he was appointed to the Agriculture & Livestock Committee by House Speaker Tom Craddick. REP. HEFLIN FILES BILL TO RESTORE CHIP PROGRAM AUSTIN (January 27, 2007)—State Representative Joe Heflin has filed House Bill 824 to restore health coverage to hundreds of thousands of Texas children through the Children’s Health Insurance Program (CHIP). In 2003, the Texas Legislature reduced state funding for CHIP and made enrollment in the program more difficult. Since the restrictive policies were enacted, almost two hundred thousand children across the state have lost their health coverage. Joining dozens of other House members to advocate and raise awareness for the repeal of the restrictive CHIP policies, Rep. Heflin said, “In District 85 alone, between 2003 and 2007 the CHIP enrollment numbers dropped by more than half. Children should be a number one priority, and that is why we need to refund CHIP, so children can have the access they need to health insurance.” Restoring the CHIP program to pre-2003 enrollment levels would not cost the state any additional money. According to data collected for the Texas Health and Human Services Commission, during the 2006 budget year the State of Texas left unspent $400 million in state funds dedicated for CHIP and Children’s Medicaid. “Those dollars could easily cover every child that has lost CHIP coverage since 2003,” said Heflin. “The money is there to do the right thing and to help working families who cannot afford private health insurance. CHIP gives the children of those hard working families health insurance, so they can grow up happy and healthy,” Heflin added. HEFLIN WELCOMES NEW COUNTY JUDGES AT JUDICIAL ORIENTATION LUBBOCK (January 23, 2007)—State Representative Joe Heflin welcomed newly-elected county judges at the Texas Judicial Academy’s Judicial Orientation for New County Judges in Lubbock, January 22-26. Following remarks by Texas Tech University School of Law Dean Walter Huffman, Heflin encouraged the judges to look forward to the exciting challenges ahead and to enjoy their new positions. Heflin suggested that the new judges make frequent visits to Austin, testify at state congressional hearings, and ensure that state legislators know and understand the needs of county governments. He also recommended that they establish regional support groups with other judges. Harkening back to his five years on the bench in Crosby County, Representative Heflin concluded, “Remember to have fun. Do not forget your families. Do not forget to have a life outside of the courthouse.
